Q – Can I inspect my purchase after I go on contract?

Someone once asked me, “When we’re going into the contract, do I have the right to inspect the property? Then, what happens?”

A: In Maui, we have an inspection period. It’s called Clause J1 .

On my contracts, typically depending on how long we do the closing, I put anywhere from 14-18 days, usually, that what gets put through in the contract, and sellers will accept that. In that time frame during the inspection period, that is when we have the opportunity for a professional home inspector to go through the home or the condo, check it out, make sure that there are no major flaws. Usually, our contracts are written “as is contracts”.

Once the home inspector finds anything, which they almost always do, as a buyer you don’t have the right to require the seller to fix anything. There are cases when you have choices, either to just accept the home as you inspected it, or cancel the contract. Those are the 2 choices in the contract that are given to a buyer.

Again, it is pretty common for a buyer to make requests to have things repaired, and the seller to agree to some, all, or none of them. Now, that all happens in the first 10 to 20 days of the contract.
