Q – Can you rent your Maui home as a vacation rental?

A – Maybe. A homeowner can buy a home, apply to the county for a vacation rental permit and send a notice to all the neighbors around.

If you’re wondering, “Can I buy a Maui home and then rent it out as a vacation rental property?”

The answer is maybe.

Most homes in Maui are zoned which means that they don’t allow vacation rentals. There may be a few homes at the beach on Wailea and in Kaanapali that are zoned property. For the most part, vacation rentals aren’t allowed in single family homes.

However, recently there has been new laws, such as the bed and breakfast law, as well as an ordinance, and a transient vacation rental accommodation law.

A homeowner can buy a home, apply to the county for a vacation rental permit and notify the surrounding neighbors. We are seeing more of those and they are not real common. There may be a limit on how many you can have in each area.

One thing to keep in mind, that if a property has a vacation rental license and it’s been marketed that they have it, it does not automatically mean that it will transfer to a new buyer. You will need to reapply for the license if you are purchasing the property and want to use it as a vacation rental.
